Right of Way and Centerline Determination

Rights of Way for roads and easements are not always obvious and can sometimes be difficult to ascertain.  It may be necessary to obtain Preliminary Title Reports for properties adjacent to the subject road or easement.  Research is conducted to identify adjoining property deeds and we typically coordinate with the local agency that the roadway is in to see if they might have information regarding the legal description for the roadway.  It is a common practice for local agencies to rely on “Prescriptive Rights”  and no legal description for the actual roadway is recorded.  In this type of case, we would need to identify the limits of private ownership by conducting Property Boundary Surveys adjacent to the roadway in order to determine the road right of way (if one exists).
